Return Terms and Conditions

General Conditions

(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 and subsequent amendments and additions)

Premise and Effectiveness of the General Conditions

These general terms and conditions of sale (hereinafter, “General Conditions”) are aimed at regulating the purchase, made remotely, of products made available on the website www.trivellitartufi.it (hereinafter, the “Site”), in compliance with Italian legislation under Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”).

The seller of the products is: Trivelli Tartufi Srl, with registered office at S.P. bivio Agelli 86, 63093 Roccafluvione (AP), n. REA: AP – 176613, Email address: info@trivellitartufi.it (hereinafter “Trivelli Tartufi Srl”).

The consumer who accesses the Site to make purchases (hereinafter “Client”) is required, before sending the order, to carefully read these General Conditions which are made available to him on the Site and which will be accessible at all times even through the link contained in the confirmation email of each order, to allow their reproduction and storage.

In case the person making purchases on the Site requests the issuance of an invoice and/or is not a “consumer or user” as defined in art. 3, paragraph 1, letter a) of the Consumer Code, the withdrawal regulations referred to in arts. 7 and 8 of these General Conditions will not apply, nor will the provisions that, according to the same Consumer Code, apply only to “consumers.”

The contracts concluded with Trivelli Tartufi Srl through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

Choosing and Ordering Products

The characteristics and price of the various products for sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.

To purchase the Products, the Client must complete and send the order form in electronic format, following the instructions on the Site. The Client must add the Product to the “cart” and, after viewing and accepting the General Conditions and the Privacy Policy, must enter the shipping and billing data, select the desired payment method, and confirm the order.

By submitting the order from the Site, which has the value of a contractual proposal, the Client acknowledges and declares that he has read all the information provided during the purchase process and accepts these General Conditions and payment terms in full.

The contract stipulated between Trivelli Tartufi Srl and the Client is to be considered concluded with the acceptance of the order by Trivelli Tartufi Srl. This acceptance is communicated to the Client through an email confirming the order itself, containing a reference to these General Conditions, the order number, shipping and billing data, the list of ordered Products with their essential characteristics, and the total price, including delivery costs. The Client must check the confirmation email and, if any errors in the order are identified, must contact Customer Service directly from the Site using the “Contacts” area and create an email indicating the order number within 6 hours of receiving the email. After this deadline, the order will be processed for shipment and no changes will be accepted, without prejudice to the Client’s rights under article 7.

Once the order is received, Trivelli Tartufi Srl will check the stock availability for the fulfillment of the order. If one or more Products are not available, Trivelli Tartufi Srl will promptly notify the Client via email, who, within the next 6 hours, will have the option to reply to confirm the shipment of any additional available Products or to cancel it. If no response is received within this period, the order will be considered confirmed, and the available Products will be shipped. In the case where only a few Products are out of stock, Trivelli Tartufi Srl will fulfill the order with the available Products. In both cases, the amount related to the missing Products will be immediately refunded according to the chosen payment method.

Product Information

Information and characteristics related to the Products are available, with the related Product codes, on the Site.

The visual representation of the Products on the Site, where available, usually corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products themselves is solely for presentation purposes and may not perfectly represent their characteristics and quality, differing in color and size. In case of discrepancy between the image and the written product sheet, the description of the product sheet will always prevail.

Prices and Shipments

Prices for the products include all taxes and fees. All prices are expressed in Euros.

Shipping: Throughout Italy, the shipping cost is €15.00 and will be free for single purchases of at least €50.00.

Payment Methods and Invoicing

Payment Methods

The Client can make the payment for the Products and the related delivery costs by credit card, PayPal, Satispay, Scalapay, Google Pay, Apple Pay.

Credit Card

The circuits on which it is possible to purchase within the Site are:

  • Visa / Visa Electron
  • Mastercard
  • Maestro
  • American Express

To ensure maximum security, the Client will carry out the payment transaction directly on the secure server of the bank. The Site does not store the Client’s credit card number, but thanks to the protected communication system of the reference credit institution, from the second purchase, the Client who so desires – through the selection of the appropriate option – can proceed with the purchase without re-entering their data. The reference credit institution uses the SSL protocol to encrypt the data transmitted between its server and the Client’s browser.

PayPal, Satispay, Google Pay, Apple Pay

Once the order is confirmed, the Client will be redirected to the site of the requested transition entity where they can make the payment with their account or using a card, including prepaid, or in any case according to the methods accepted by the entities themselves and in compliance with their conditions.

Scalapay

Once the order is confirmed, the Client will be redirected to the Scalapay site where they can register and decide the payment installments that can be settled using a card, including prepaid, or in any case according to the methods accepted by Scalapay and in compliance with their conditions.

Transport and Delivery

Products purchased on the Site will be delivered to the address indicated by the Client during the purchase process in the “Shipping Data” field.

All purchases will be delivered via DHL express courier (hereinafter, “Courier”) from Monday to Friday, excluding holidays and national holidays. Trivelli Tartufi Srl is not responsible for unforeseeable delays or delays not attributable to it.

Once the Products have been shipped, the Client will receive a confirmation email.

In any case, except in cases of force majeure or fortuitous events, the ordered Products will be delivered within a maximum period of fourteen working days from the day following the one in which Trivelli Tartufi Srl confirmed the order to the Client via a specific order confirmation email.

The service includes two delivery attempts at the address indicated at the time of the order. After each attempt, a notice will be left. After the second unsuccessful delivery attempt, the Courier will contact the recipient of the order by phone at the number provided to arrange the delivery. If the recipient cannot be reached or is absent, the goods will return to the warehouse.

Right of Withdrawal

According to the provisions of Legislative Decree 206/05, the Client has the right to withdraw from the purchase contract of the products, without any penalty, subject to written notification to be sent to Trivelli Tartufi Srl, using the return management procedures provided by Trivelli Tartufi Srl;

  • within seven calendar days of receiving the goods, in the case of stored products;
  • within 6 hours of delivery in the case of fresh truffle.

It is not possible to change the selection or the chosen product with another without additional costs. The Trivelli Tartufi Srl customer service is always available to try to resolve any needs related to the order, so the Client can contact Trivelli Tartufi Srl directly via email at enquiries@trivellitartufi.it.

In the communication, the Client must indicate the product or products for which they intend to exercise the right of withdrawal, the order number, and the order date. Once the communication has been made, it is necessary to await a response from the Trivelli Tartufi Srl Customer Service to authorize the return. The Client can then return the goods to be returned by delivering them to the courier for shipping:

  • within an additional seven calendar days, in the case of stored products;
  • within the day following delivery in the case of fresh truffle,

within the terms and conditions agreed upon, except for any waiver of the return of said products. The fresh truffle must be repackaged in the same way it was received by the Client, ensuring that the cold accumulator is sufficiently frozen.

The only expenses that the Client will have to bear are those for returning the purchased products, in accordance with art. 5, comma 6, of Legislative Decree No. 185 of 22/05/1999. The Right of Withdrawal, in addition to complying with the terms and conditions described in the previous points, is considered correctly exercised if the following conditions of the right of withdrawal are fully met:

  • the purchased products must be substantially intact;
  • the products must be returned in their original packaging;
  • the returned products must be sent to Trivelli Tartufi Srl in a single shipment. Trivelli Tartufi Srl reserves the right not to accept bottles or products from the same order, returned and shipped at different times;
  • the return shipping costs will be borne by the Client, including the liability in case of loss or damage to the products;
  • the products received in the warehouse will be examined to assess any damages or tampering (the substantial integrity of the returned goods is an essential condition for the exercise of the right of withdrawal) – We recommend the utmost attention in preparing the package;
  • the products must not have been opened, used, or damaged;
  • the right of withdrawal is reserved only for individuals, thus excluding any purchases made by resellers or entities that purchase for resale purposes;
  • the return request must be correctly completed and transmitted to Trivelli Tartufi Srl within fourteen calendar days from the receipt of the products.

If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph, Trivelli Tartufi Srl will refund the sums already collected for products purchased directly from the site www.trivellitartufi.it, and in the case of total withdrawal (return of all purchased goods) any shipping costs paid at the time of the order, which will be refunded to the Client as soon as possible and, in any case, within fourteen calendar days from the date on which Trivelli Tartufi Srl became aware of the exercise of the right of withdrawal. The refund procedure will be activated once the terms and conditions indicated above have been verified, as stated in the following paragraph 8.

If the terms and conditions for exercising the right of withdrawal have not been respected, the Client will not be entitled to a refund of the amounts already paid to Trivelli Tartufi Srl or to the issuance of the requested credit. It will always be possible, however, to retrieve, at their expense, the products in the state in which they were returned to Trivelli Tartufi Srl. Otherwise, the company may withhold the products, in addition to the amounts already paid for their purchase.

Refund Times and Methods

Once the products have been returned, Trivelli Tartufi Srl will carry out the necessary checks regarding conformity to the conditions and terms indicated in the previous paragraph. If the checks are positive, Trivelli Tartufi Srl will send the Client, via email, the confirmation of acceptance of the returned products. Whatever the payment method used by the Client, the refund will be activated by Trivelli Tartufi Srl as soon as possible and, in any case, within fourteen calendar days from the date on which Trivelli Tartufi Srl became aware of the exercise of the right of withdrawal, subject to verification of the correct execution of the right of withdrawal itself and the acceptance of the returned products.

In the case where there is no correspondence between the recipient of the products indicated in the order form and the person who carried out the payment of the sums due for their purchase, the refund of the amounts, in the case of exercising the right of withdrawal, will be executed by Trivelli Tartufi Srl, in any case, in favor of the person who made the payment.

Errors and Liability Limitations

The information regarding the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Trivelli Tartufi Srl cannot be considered responsible, except in the case of fraud or gross negligence. Trivelli Tartufi Srl reserves the right to correct errors, inaccuracies, or omissions even after an order has been sent, or to change or update the information at any time without prior communication, without prejudice to the Client’s rights under these General Conditions and the Consumer Code.

Except in cases of fraud or gross negligence, any right of the Client to compensation for damages or recognition of compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or partial execution of an order, is excluded.

Complaints

Any complaint must be sent to Trivelli Tartufi Srl using the appropriate contact form accessible directly on the Site in the “Contacts” area or using the email: info@trivellitartufi.it Trivelli Tartufi Srl is committed to responding to all requests within a maximum of 7 working days.

Applicable Law and Jurisdiction

The sales contract between the Client and Trivelli Tartufi Srl is understood to be concluded in Italy and regulated by Italian law. For the resolution of disputes relating to the interpretation, execution, or resolution of these General Conditions or individual purchase orders, the exclusive jurisdiction will be that of the Court of Ascoli Piceno, excluding any other competent court.

Pursuant to Article 1341 of the Civil Code, the Client declares to have read and specifically accept the following articles of these General Conditions: 6 (transport and delivery), 9 (errors and liability limitations).
